These terms cover how your company uses Gralivant to book, confirm on a phone call, and pay for solar appointments.
By creating an account or using the platform, you agree to them.
1. Who these terms cover
These terms are an agreement between Gralivant LLC ("Gralivant," "we," "us") and the company that creates an account on the platform ("you," "your"). The platform is for solar closer companies that use it to receive, confirm, and pay for homeowner appointments.
Each person you allow to sign in to your account acts on your company's behalf, and your company is responsible for what happens on your account.
2. What the platform does
Setters book appointments with homeowners on your behalf. When an appointment is booked, we place a hold on your balance for that appointment's cost.
You call the homeowner through the app to confirm the appointment. The call is recorded and transcribed, and reviewed by an automated quality check and sometimes by a person. See the recording notice for how that works.
After you hang up, you report whether the appointment is confirmed or declined. Before that report, you only see the homeowner's first name, city, ZIP code, the appointment time, the setter's first name, and the hold amount. Full details unlock only after the hold is captured.
3. How holds are captured and released
A hold is captured, and you are charged, when any of the following happens: you report the appointment as confirmed, the quality review finds that the homeowner confirmed the appointment on the call, or the quality review finds that you asked for or shared a locked detail (the homeowner's last name, street address, phone number, or email) off script during the call.
A hold is released, and you are not charged, when a decline is verified or the scheduled appointment time passes with no confirmation.
4. Fees and payments
You preload a balance, and each confirmed appointment is charged against it at your cost per appointment. Your cost per appointment and any one-time setup fee are shown to you before you pay and may change with notice. The setup fee is a separate, one-time payment and never adds to your balance.
Payments happen on a hosted checkout page run by our payment provider. We never see or store your full card number. At checkout, our payment provider may offer to let you pay over time; eligibility and terms for that option are set by the payment provider, not by us, and we make no promises about it here.
Once an appointment is confirmed and its hold is captured, that charge is final. If the homeowner later does not attend the appointment, we do not refund that charge. At our discretion, we may offer a credit or a replacement appointment instead.
You may turn on auto-reload, which charges your saved card a chosen amount whenever your balance falls below a chosen threshold. Auto-reload only runs with your explicit consent, and you can switch it off at any time in Balance. If your balance reaches zero, new bookings pause until it is funded again.
5. Territory
A ZIP code assigned to your account is exclusive to your company for as long as it stays assigned to you. Assignments can change; we will tell you when yours does.
6. Your responsibilities with homeowner data
A homeowner's information belongs to a real person, not to you. You may use it only to attend and sell the specific appointment it was given to you for. You may not resell it, share it outside your company, or use it for any other purpose.
You are responsible for following the telemarketing, do-not-call, and call-recording laws that apply to you and to the homeowner, in both of your locations, including getting any consent those laws require before you speak with a homeowner.
7. Notifications and your calendar
We notify you about appointments by email and inside the app. The platform does not send text messages to you or to homeowners.
You may optionally connect your Google Calendar. If you do, we write confirmed appointments to it. You can disconnect that at any time in Settings.
8. Suspending or closing an account
We may suspend or close your account if you do not pay, misuse homeowner data, break the recording or telemarketing rules above, or try to get locked details off script. We will tell you why when we can.
You may close your account by contacting support@gralivant.com. We will stop new bookings and auto-reload, reconcile outstanding appointment holds and charges, and return your verified unused prepaid balance to the original payment method. Promotional credits have no cash value. Earned appointment charges and the one-time setup fee are not unused balance. Amounts involved in a dispute or chargeback remain subject to resolution; we will not refund an amount twice. Refunds are subject to payment-provider processing times and applicable law. If the original method cannot receive a refund, contact support to arrange a verified alternative.
9. No guarantees, and our liability
We do not guarantee appointment volume, close rate, or income. We guarantee that we run the system as described here and that you only pay for appointments you confirmed yourself, or that the review found you confirmed or tried to get locked details on the call.
The platform is provided as-is. To the extent permitted by law, Gralivant is not liable for indirect or consequential losses. Gralivant’s total liability arising from the platform or these terms is limited to the greater of $500 or the service fees you paid Gralivant during the 12 months before the event giving rise to the claim. For this purpose, service fees include captured appointment charges and setup fees, but exclude unspent prepaid balance. This limit does not reduce our obligation to return unused balance under the account-closure policy, or limit liability for fraud, willful misconduct, or anything the law does not permit us to limit.
10. Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules.
11. Changes to these terms
We may update these terms from time to time. If we make a material change, we will update the date at the top of this page. Continuing to use the platform after a change means you accept it.
